**TERMS AND CONDITIONS FOR Yoga & Meditation Retreat with Susan and Mark
These terms and conditions (“Terms”) set out the basis on which your retreat with Mark and Susan (hereinafter referred to as “we”, “us”, or “our”) will provide services to you, the guest (hereinafter referred to as “you” or “your”). Please read these Terms carefully, as they affect your legal rights.
1. Booking
1.1. All bookings are subject to availability. A non-refundable deposit of 50% of the total cost is required to secure a booking. The deadline for deposits is 2nd July. There are ten spaces available, and the first ten deposits received secure a space.
1.2. Full payment must be made at least 30 days prior to the start date of the retreat. If the booking is made within 30 days of the retreat, full payment will be required at the time of booking.
2. Cancellation Policy
2.1. In case of cancellation by you more than 30 days prior to the start date of the retreat, the deposit will be forfeited, but any additional amount you have paid will be refunded.
2.2. For cancellations made by you less than 30 days before the start date of the retreat, the entire amount will be non-refundable.
2.3. In the unlikely event we need to cancel the retreat for any reason, you will be offered a full refund or the option to book another retreat. We are not responsible for any additional expenses you may have incurred in preparation for the retreat, such as airfare.
3. Medical Conditions and Special Requirements
3.1. You must disclose any medical condition, physical disability, or other condition that may affect your ability to participate fully in the retreat. We reserve the right to refuse participation if we deem it necessary for your safety or the safety of others.
3.2. You are responsible for managing any dietary, medical or other personal requirements during the retreat. Please inform us of any special needs at the time of booking.
4. Risk Acknowledgment
4.1. You acknowledge that participation in a yoga and meditation retreat involves physical exertion and potential exposure to injury. You are fully aware of the risks and hazards involved and agree to accept any risks associated with the retreat.
4.2. It is your responsibility to consult with a Doctor prior to and regarding your participation in the retreat.
4.3 You are responsible for arranging your medical insurance for the trip, and you should have this in place before you travel.
4.4 whilst the sea is calm and shallow - should you decide to go swimming in the sea at any time, this is completely at your own risk
4.5 The retreat will offer a glass of wine or a beer at meal time should you wish for a drink or two, we accept no loss, damage or injury claims if you have consumed alcohol. this is completely at your one risk
5. Liability
5.1. To the fullest extent permitted by law, we accept no liability for loss, damage, injury or illnesses which may be received during your stay or travelling to and from the arrival airport in Italy to the retreat and back to the airport of departure.
6. Images and Marketing
6.1. We reserve the right to take discreet photographic or film records of any of our retreats and may use any such records for promotional and/or commercial purposes. Although we do ask your permission beforehand.
7. Complaints
7.1. If you have a problem during your retreat, please inform Mark & Susan immediately, and we will endeavour to make things right. We can only correct a problem if we are aware of it.
8. Travel Arrangements
8.1. All travel arrangements are your responsibility and at your own cost. The 2023 Italy Retreat with Mark & Susan shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have arranged to use for your travel needs or for any irregularities in your travel arrangements.
8.2. We strongly recommend that you arrange your travel insurance to cover any potential cancellation of your travel plans, including flights, as well as provide adequate medical cover for sickness, accidents or injury.
8.3. We are not responsible for any additional expenses you may incur resulting from delayed/cancelled travel arrangements, including but not limited to costs of accommodation, meals, or alternative travel arrangements.
8.4. If you are delayed in your arrival to the retreat due to travel delays or cancellations, it is your responsibility to catch up on any content you may miss.
8.5. Travel documents. For events outside the U.K. (or your home country, if you are not a U.K. citizen), you and your guests, where applicable, must carry a valid passport and have obtained all other required travel documents (visas, permits, certificates etc.) for the country(ies) you will visit during your event. For many countries, your passport must be valid for at least six months beyond the duration of the event; please make sure to research the applicable passport requirements for each country you plan to visit. It is your responsibility to ensure that you are in possession of all such required travel documents for your trip. We are not responsible if you are refused entry to a country because you lack the correct travel documents.
8.6. By confirming your booking, you acknowledge that The 2023 Italy Retreat with Mark & Susan has provided this information to you, and you accept the responsibility for arranging and paying for your own travel arrangements.
9. What is included/excluded from the retreat price
9.1. The price includes the following:
• Accommodation and all meals within the Masseria
• Yoga and Meditation every day, plus workshops or training as advertised.
9.2. The price does not include the following:
10. Suppliers
10.1. Villas, shuttle services ( as advertised) or other constituent elements of the event will be arranged by Mark Nicholls Meditation (Mark Nicholls) in conjunction with Bohoco Life ( Susan Kind & Mark Nicholls) - known as we.
We work with suppliers local to the regions in which we curate the events, who may themselves engage the services of other local operators and/or sub-contractors. We will at all times endeavour to appoint reputable and competent local suppliers. The terms and conditions of the suppliers will be applicable and are expressly incorporated into these Terms, and the guest assents to those terms and conditions and the limitations and obligations contained therein. These may limit or exclude the liability of the supplier. The liability of Mark Nicholls Meditation working with and as Bohoco. Life will not exceed that of any supplier. All suppliers will be selected and assessed by Mark Nicholls Meditation / Bohoco.life in reference to local laws and regulations in the relevant country of operation. Mark Nicholls Meditation / Bohoco. Life will not be liable for the acts or omissions of any independent contractors.
11. Changes to these Terms
11.1. We reserve the right to update these Terms occasionally without notice. The Terms at the time of your booking will apply.
12. Your details
12.1. To confirm your booking, you must provide us with certain personal information. The precise information may vary from retreat to retreat, but the types of information we may require include, for example, full name (as it appears on your passport), passport number, copy of passport photo page, home address, next of kin and date of birth.
13. Jurisdiction
13.1. This agreement shall be construed in accordance with the laws of England and Wales, and the courts of England shall have exclusive jurisdiction to deal with any disputes arising between you and us or our suppliers.
14. Arbitration
14.1. You agree that any dispute relating to your booking, the Terms & Conditions, the Agreement or any other issues relating to your event (including any claim you may wish to assert relating to or arising out of your event) shall be referred to confidential and binding arbitration in the United Kingdom, by the arbitrator(s) and pursuant to rules of arbitration subject to the mutual agreement of the parties. If the parties cannot agree on the arbitrator(s) and/or the rules of arbitration, arbitration may be compelled by petition to any court of competent jurisdiction in the United Kingdom. Any arbitration award shall be rendered in writing and may be entered and shall be fully enforceable as a judgment in any court of competent jurisdiction. The parties expressly waive their right to trial, including trial by jury. Each party shall bear its own lawyer's fees and costs.
15. Complaints
In the unlikely event that you have a complaint during or after an event with us, you must bring it to our attention immediately. If your complaint is not resolved, then you must repeat your complaint in writing within seven days of the end of your event with us by emailing us at hello@bohoco.life. No complaint will be accepted outside of this time frame, thus deeming you fully satisfied with all aspects of the event and the services we have provided to you. We will acknowledge any correspondence within seven days and endeavour to deal with the complaint as quickly as possible. You must provide any booking reference and all other relevant information to enable us to investigate your complaint fully. For complaints which do not involve death, personal injury or illness and which are not made in accordance with this procedure, we will be unable to accept liability.
15. Privacy policy and data protection
Any personal information that we collect about you may be used for any purpose associated with the operation of an event or to send you marketing material in relation to our events creation and special offers. The information may be disclosed to our partners (who may be located outside the United Kingdom/EEA), service providers or other suppliers to enable us to operate the event. Only information necessary for this purpose will be disclosed to them. On occasion, it may be mandatory for us to disclose information for security and terrorism purposes and any other purpose imposed upon us by governments or other regulatory authorities. We may disclose this information to companies which act as data processors on our behalf. We need this information to cater for your needs, but it is collected on condition that we have your positive consent. We will collect the name and telephone number of an emergency contact for you prior to every yoga retreat. We will use this information and contact this person only for emergency reasons. We may disclose this person’s name and telephone number to third parties such as villa managers, our instructors, or medical professionals (who may be located outside the United Kingdom/EEA) if needed in an emergency. By giving us this information, you consent to this disclosure. We will collect your contact details via the booking form, as well as from enquiry emails sent to us directly and newsletter sign-up requests. By giving us your contact details, you agree that from time to time, we may contact you with information about special offers or future yoga retreat packages. If you do not wish to receive such information, please notify us. We will use your mobile number for a potential Whatsapp group that we might create at the start of the retreat to communicate with everyone in the group. You agree to have your mobile number shared with other participants of the yoga group as well as with the yoga retreat organiser and with the yoga teacher. We will not share your contact information with any third-party agencies for marketing solicitation purposes. You have the right to ask us in writing for a Data Access Request Form to obtain a copy of the information we hold about you. You will be charged a fee for this. 16. Waiver of liability and release
You acknowledge and agree that Bohoco.life / Mark Nicholls Meditation and its affiliates, subsidiaries, officers, directors, shareholders, members, employees, successors and assigns (collectively, the “ER Parties”) shall not be liable for any direct, indirect, consequential or incidental damage, liability, injury, loss, cost or expense you may incur (including any claim relating to personal injury, illness, death, property damage or loss, delay or other inconvenience) arising out of or by reason of (i) the acts or omissions of any Third Party Operator or (ii) the negligence of any of the ER Parties or (iii) any acts or omissions of any other parties or (iv) force majeure circumstances. You release the ER Parties from any and all claims, liabilities, losses, expenses, damages, demands, actions, causes of action, lawsuits or sums of money of any kind arising out of, by reason of, resulting from and/or related to any trip you may book and/or participate in; and you understand and acknowledge that you are fully responsible for and expressly assume any and all risks, whether known or unknown, in connection therewith.
17. Alcohol | Drugs policy
Guests should not practise yoga or meditation under the influence of alcohol, drugs, or both. Your use of any recreational drugs other than alcohol and tobacco where permissible will result in immediate dismissal of the activity, with no refund being issued. You will then be responsible for then making your own way home or staying as retired in the accommodation of the retreat and excluded from all activities.
18. Immunisations | Travel advisories| Warnings
Each guest assumes full responsibility for verifying any requirements relating to and/or obtaining any immunisations which may be necessary or desirable for travel in the applicable country(ies) and/or region(s). Each guest also assumes full responsibility for researching the safety and security conditions in the applicable country(ies) and/or region(s) during the period of scheduled travel, and being aware of any applicable travel advisories and/or warnings. Guests may also wish to consult a physician who is knowledgeable about travel medicine and related medical issues in the country(ies) and/or region(s) to be visited.
19. Website, brochures and advertising
The information provided on our website, brochures and advertising materials is to the best of our knowledge, and we believe it is correct at the time of publishing. Occasionally errors may occur, and information may change, so you must therefore check all the details of each venue and supplier at the time of booking.
20. All parties attending the retreat will leave at the same time
21. The retreat location is not a tourist one and is in a rural location away from tourist shops and facilities.
By booking The 2023 or 2024 Italy Retreat with Mark & Susan, you agree to these terms and conditions.
The 2023 or 2024 Italy Retreat with Mark & Susan, reserves the right to modify these terms and conditions at any time.
